These Terms & Conditions apply to rides provided through or under the TRAFIGO brand in Denmark.
They apply whether your ride is:
Some sections, such as those concerning the TRAFIGO app, digital payments or cancellation of bookings, only apply where the relevant service is used.
By using TRAFIGO or taking a ride provided under the TRAFIGO brand, you agree to the terms applicable to that ride.
TRAFIGO is a ride, booking and technology platform.
In Denmark, rides are sold by licensed Danish taxi dispatch offices (kørselskontorer).
The following companies operate as TRAFIGO dispatch offices:
TRAFIGO ApS
CVR 44926784
Thorsvej 1
8722 Hedensted
Denmark
Connect+ ApS
CVR 44926687
Thorsvej 1
8722 Hedensted
Denmark
The dispatch office responsible for a particular ride will be identifiable from the booking information, vehicle information, receipt and/or other information provided in connection with the ride.
Additional licensed dispatch offices may become part of the TRAFIGO network in the future. Current information will be available on our Taxi Legal Information page.
GOTRAFIGO LLP acts as agent in connection with rides offered through the TRAFIGO platform.
Depending on the booking channel and market, GOTRAFIGO LLP may provide services including:
Where GOTRAFIGO LLP acts as agent, it acts on behalf of the relevant service provider.
GOTRAFIGO LLP does not itself provide the licensed physical ride in Denmark.
The involvement of GOTRAFIGO LLP does not change which Danish licensed dispatch office is responsible for the ride under Danish taxi legislation.
For rides obtained directly from a vehicle, including street-hail and taxi-rank rides, GOTRAFIGO LLP may have no involvement in the transaction.
The physical ride may be carried out by an independent licensed transport company affiliated with the relevant dispatch office.
We refer to that company in these Terms as the Operator.
The individual performing the ride is referred to as the Driver.
Different Operators and Drivers may perform rides under the TRAFIGO brand.
The use of an independent Operator does not remove the responsibilities imposed on the relevant Danish dispatch office under applicable Danish taxi legislation.
You may request a ride through any booking channel made available by TRAFIGO.
Depending on availability, you may request:
When booking, you must provide accurate information necessary for us to perform the ride.
This may include:
A booking made through the TRAFIGO platform is confirmed when confirmation is communicated through the relevant booking channel.
We may assign or reassign a booking to another suitable Driver, vehicle or Operator where necessary.
A request for a ride does not guarantee that a suitable vehicle will always be available.
Availability may depend on factors including:
Where no suitable vehicle can be assigned, we may decline or cancel a request.
If a prepaid ride is cancelled by us and no replacement ride is accepted, the amount paid for the cancelled ride will be refunded.
For rides requested for immediate pickup, any pickup time or estimated time of arrival shown or communicated is an estimate.
Actual arrival times may vary because of traffic, demand, road conditions, weather, previous rides or other circumstances.
We will make reasonable efforts to provide the ride as requested but do not guarantee an estimated arrival time unless expressly agreed.
You may book certain rides in advance for a specified pickup time.
A pre-booking means that the ride is planned for the requested time.
Unless expressly agreed otherwise, a pre-booking is not a guarantee that the vehicle will arrive at the exact minute requested.
Traffic, weather, accidents, road closures, vehicle breakdowns, extraordinary demand and other operational circumstances may affect the actual pickup time.
If circumstances materially affect a pre-booked ride, we will make reasonable efforts to inform you using the contact information provided with the booking.
Cancellation and no-show conditions may apply to pre-booked rides.
These are described in our Price Terms and, where applicable, will be displayed during the booking process.
You may also take a TRAFIGO ride directly from an available affiliated vehicle on the street or from a taxi rank.
For these rides, no prior digital booking is required.
Unless a fixed price has been expressly agreed before the ride, the price will be calculated using the applicable taximeter rates of the dispatch office responsible for the vehicle.
The TRAFIGO app and TRAFIGO LLP are not necessarily involved in these rides.
The way your ride price is calculated depends on how the ride is purchased.
A ride may be provided:
All prices are subject to applicable Danish legislation.
Where no fixed price has been agreed before the ride, the price is calculated using the applicable rates of the relevant dispatch office.
This will typically apply to street-hail and taxi-rank rides.
The taximeter will be used as required by Danish law.
A fixed price may be agreed before a specific ride.
This may include rides booked through the TRAFIGO app, website, telephone or another booking channel.
Where a fixed price is offered digitally, the price will normally be displayed before you confirm the ride.
Once agreed, the fixed price applies to the ride as booked.
If you materially change the ride after booking, for example by:
a revised price may apply.
For a fixed-price ride, the agreed price will be displayed on the taximeter as required by applicable Danish taxi legislation.
Current rates and charges are available in our Price Terms and official Price Sheet.
These may include:
Prices may differ depending on the time, type of ride, booking method or other circumstances where permitted by law.
For rides where the price has been agreed in advance, the agreed price will comply with the pricing requirements applicable to Danish licensed dispatch offices.
Bridge tolls, ferry charges, parking charges and similar third-party costs may be added where applicable and permitted.
You may cancel a booked ride through the available booking channel.
Depending on when you cancel and the circumstances of the booking, a cancellation fee may apply.
A cancellation fee may for example apply where:
The current cancellation rules and applicable charges are stated in our Price Terms and may also be displayed before a booking is confirmed.
No customer cancellation fee applies where the relevant TRAFIGO dispatch office cancels the ride.
If you believe that a cancellation fee has been charged incorrectly, you may contact TRAFIGO Support and request a review.
You must be ready at the agreed pickup location at the agreed time.
Where reasonably possible, the Driver or TRAFIGO may attempt to contact you if you cannot be located.
If you are not available within the applicable waiting period, the Driver may cancel the ride.
The booking may then be treated as a no-show.
A waiting-time or no-show charge may apply where stated in our Price Terms.
You may ask the Driver to change the destination, make an additional stop or otherwise change the ride.
The Driver may decline a requested change if it cannot reasonably or lawfully be accommodated.
A material change may result in a revised price.
Where a fixed price was originally agreed, the original fixed price only applies to the ride as booked.
Available payment methods may vary depending on the booking method and ride.
Payment may include:
You are responsible for paying all amounts properly due for the ride.
Where a ride is paid through the TRAFIGO platform, TRAFIGO LLP may act as agent for the purpose of collecting and processing payment.
By selecting a digital payment method, you authorise the relevant payment service provider and TRAFIGO LLP, where applicable, to process amounts properly due in connection with your ride.
Payment processing may be carried out by external regulated payment providers.
A temporary payment authorisation or reservation may be placed on your payment method where required by the payment provider.
The entity processing or collecting a payment may be different from the Danish dispatch office responsible for the ride.
This does not change the identity of the party legally responsible for the Danish ride.
If an electronic payment cannot be completed, we may attempt to collect the outstanding amount again using an authorised payment method associated with your account.
Access to certain digital services may be restricted until an outstanding amount has been paid.
Where a passenger is unable to pay after a ride taken directly in a vehicle, the passenger must provide sufficient information to identify themselves, including name and address, and provide reasonable identification if requested.
Reasonable administration, collection and recovery costs may be added where permitted by law.
Drivers are not required to accept personal property as security for an unpaid amount.
After a ride, you will receive the ride information required under applicable law.
Depending on the booking and payment method, this may be provided electronically or through the equipment installed in the vehicle.
For Danish rides, the relevant ride documentation may include information such as:
Where TRAFIGO LLP has collected payment as agent, payment documentation may also identify TRAFIGO LLP in its capacity as agent.
Certain additional services may be available for specific rides or vehicles.
Where an additional service carries a charge, the applicable price will be published in our Price Terms or otherwise disclosed before purchase where required.
No charge will be imposed for bringing a wheelchair, guide dog or similar aid where Danish taxi legislation prohibits such a charge.
If you have accessibility requirements, please provide the relevant information when booking so that an appropriate vehicle can be assigned where available.
A passenger using a wheelchair, guide dog or similar aid will not be charged an additional fee merely for bringing that aid where prohibited by law.
Availability of specially equipped vehicles may depend on location and time.
Children are welcome on TRAFIGO rides subject to applicable road-safety requirements.
The person responsible for the child must inform us in advance if a particular restraint, seat or vehicle configuration is required.
Where a specific child seat or other equipment is requested, the booking should not be regarded as confirmed for that requirement until its availability has been confirmed.
Normal passenger luggage may be transported where it can be accommodated safely in the vehicle.
Large, heavy, unusual or excessive luggage should be disclosed when booking.
A Driver may refuse to transport an item where it cannot safely or lawfully be carried.
TRAFIGO is not a specialist freight service.
Items requiring specialised handling, including particularly fragile, dangerous, perishable or irreplaceable items, should not be transported unless expressly agreed.
Where bicycle transport is offered, you must state when booking that you wish to bring a bicycle.
A bicycle can only be carried where:
The Driver may make the final reasonable safety assessment before accepting the bicycle.
Any applicable charge will appear in our Price Terms.
A bicycle carried externally may be exposed to weather, dirt and ordinary minor marks associated with transportation.
Passengers must behave lawfully and reasonably during a ride.
You must not:
You must comply with reasonable safety instructions from the Driver.
The number of passengers must not exceed the legal capacity of the vehicle.
Smoking is not permitted in the vehicle.
A Driver may refuse to begin or may end a ride where this is reasonably necessary for safety or legal reasons.
You are responsible for reasonable costs resulting from deliberate or negligent damage caused by you or a passenger travelling as part of your booking.
A cleaning charge may also apply if a passenger causes exceptional soiling, contamination, odour or other conditions requiring the vehicle to be taken out of service for cleaning.
Any standard cleaning charges will be described in our Price Terms.
Where the actual damage materially exceeds a standard charge, reasonable documented costs may be claimed to the extent permitted by law.
Drivers will normally take a reasonable route taking account of:
The shortest geographical route will not always be the fastest or most appropriate route.
For a fixed-price ride, an ordinary route change initiated by the Driver does not in itself change the agreed price.
Pickup times and arrival times are estimates unless we have expressly agreed otherwise.
Traffic, accidents, road closures, weather, vehicle breakdowns, extraordinary demand and circumstances outside reasonable operational control may cause delays.
To the extent permitted by law, TRAFIGO and the relevant dispatch office are not liable for indirect or consequential losses arising solely because a ride is delayed, cancelled or does not achieve a particular onward connection.
This may include losses relating to:
Nothing in this section limits liability that cannot lawfully be excluded or limited.
We may cancel or discontinue a ride where reasonably necessary.
This may include circumstances involving:
Where we cancel a prepaid ride and no replacement ride is provided and accepted, the payment for the cancelled ride will be refunded.
f you believe that you have left an item in a vehicle, please contact TRAFIGO through the relevant Support contact form as soon as possible.
Please provide as much information about the ride as possible.
We will make reasonable efforts to identify the relevant vehicle and contact the Operator or Driver.
We cannot guarantee that lost property will be located or returned.
Unclaimed property may be handed to the police or otherwise handled in accordance with applicable rules.
Reasonable costs associated with returning an item may be charged where agreed with you.
TRAFIGO, the dispatch office, Operator and Driver are not responsible merely because personal property has been forgotten in the vehicle, except where liability arises under applicable law.
Certain TRAFIGO services may require you to create an account.
You must provide accurate and current information.
You are responsible for keeping your login details secure and must not knowingly allow another person to misuse your account.
If you believe that your account has been accessed without authorisation, please contact TRAFIGO through the relevant Support contact form.
We may temporarily restrict an account where reasonably necessary to:
You may not use the TRAFIGO platform:
We may restrict or terminate access where there is reasonable evidence of serious or repeated misuse.
TRAFIGO may from time to time offer promotions, ride credits, discount codes or other benefits.
Separate conditions may apply to a promotion.
Unless otherwise stated, promotions:
Any specific promotion terms presented with the offer take precedence over this section.
The TRAFIGO name, logos, platform, app, website, software, design and other intellectual property are owned by or licensed to the relevant TRAFIGO entity.
Using TRAFIGO does not transfer ownership of those rights to you.
You may not copy, modify, distribute, reverse engineer or commercially exploit the TRAFIGO platform except where permitted by law or expressly authorised by us.
TRAFIGO processes personal data in connection with:
Further information about how personal data is processed, including the relevant data controllers, is available in our Privacy Policy.
Passenger transport is not subject to the ordinary statutory 14-day right of withdrawal applicable to many other online consumer purchases.
Your ability to cancel a booked ride is instead governed by our cancellation conditions and Price Terms.
This does not affect any other mandatory rights available to you under applicable law.
If you are dissatisfied with a ride, you should first contact TRAFIGO through the relevant Support contact form on our website or in the TRAFIGO app.
Where possible, please provide:
The complaint will be handled by or on behalf of the dispatch office responsible for the ride.
If a complaint concerning a Danish ride cannot be resolved directly, eligible consumer complaints may be submitted to:
Klagenævnet for Taxi
taxiklage.dk
The conditions and applicable fee for submitting a complaint are determined by Klagenævnet for Taxi.
Nothing in these Terms limits any statutory complaint rights.
The dispatch office responsible for the ride remains liable in accordance with applicable Danish law.
Nothing in these Terms excludes or limits liability:
To the extent permitted by law, neither TRAFIGO nor the relevant dispatch office is responsible for indirect or consequential losses that could not reasonably have been foreseen when the relevant agreement was entered into.
Mandatory consumer rights are not affected by these Terms.
These Terms primarily apply to individual rides.
Separate Business Terms, account conditions, framework agreements or other contractual terms may apply to rides purchased by:
Where a separate written agreement applies, that agreement takes precedence in the event of a conflict with these Terms.
We may update these Terms where reasonably necessary because of changes to:
The current version and its last-updated date will be available on the TRAFIGO website.
Changes will not retrospectively reduce rights that a customer already has in relation to a completed ride.
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.
The affected provision will apply to the greatest extent permitted by law.
Rides sold by a Danish TRAFIGO dispatch office are governed by Danish law.
Nothing in these Terms deprives a consumer of mandatory consumer protection rights.
Disputes that cannot be resolved directly may be brought before the competent complaint body or court in accordance with applicable law.
Questions, complaints and enquiries concerning a ride must be submitted through the relevant contact form on the TRAFIGO website or in the TRAFIGO app.
